Commercial and Civil Litigation

Our experienced commercial and civil litigators represent individuals as well as businesses from sole proprietorships to mid to large size companies throughout New York and New Jersey.

No business is immune from disputes that can grow into litigation and when they do – efficiency, cost effectiveness and results are the only things that matter. SKRS’ commercial and civil litigation practice covers a wide spectrum of business and personal disputes. Our Manhattan based lawyers regularly litigate matters involving all types of contractual issues, partnership shareholder disputes, breach of contract claims, business torts, real estate disputes, unfair competition, trade secrets, restrictive covenants, actions under the Racketeer Influenced and Corrupt Organizations Act (RICO), defamation, trade libel, and estate related litigation.

Our diverse commercial and civil litigation practice has required our litigation attorneys to develop an expertise with a myriad of relevant federal and state statutes and prevailing case law. The litigators regularly appear before the federal and state trial and appellate courts and before secular and religious arbitration tribunals. The firm has a successful history in litigating cutting edge commercial issues starting in 1985 when Franklyn H. Snitow, the firm’s founding partner, successfully argued Sedima v. Imrex, a case which established a private right of action under RICO, before the Supreme Court of the United States. Mr. Snitow and other attorneys at the firm have successfully argued before the New York State Court of Appeals, the First and Second Departments of the Appellate Division, and the Second Circuit Court of Appeals.

Although our litigators are comfortable going to trial, we also recognize that there are significant risks involved and therefore when possible we work with our clients and adversaries to craft solutions and settlements that resolve disputes to the mutual satisfaction of the parties.

Family and Matrimonial Law

Snitow Kaminetsky Rosner & Snitow LLP’s family and matrimonial law practice addresses the complete range of matters affecting the family in the court system, encompassing negotiated agreements, litigation, mediation, and arbitration of disputes, including before Bais Din (religious tribunals). Our firm is well-suited to meet the needs of our clients in connection with the negotiation and preparation of premarital, marital, separation, and cohabitation agreements. Our attorneys have the expertise and experience in litigating difficult cases, which require substantial and complex discovery. They are well known and well respected by the matrimonial judges who they appear before. In the event that the parties are unable to reach an amicable resolution, we are prepared to try such cases to conclusion, addressing all aspects of a divorce proceeding such as equitable distribution, custody, parenting time, and maintenance. If a client wishes to appeal a decision, we have extensive experience perfecting and arguing appeals before the Appellate Division.
